CLAUSE 1 GUARANTEE

1.1 Batavus B.V. guarantees that Bata-

vus bicycles are free from construction

and/or material defects and/or corro-

sion, in so far as this follows from these

guarantee conditions.

1.2 The guarantee can solely be invo-

ked by the ﬁ rst owner of the Batavus

bicycle in question.

1.3 The guarantee lapses in accordance

with the provisions of Clauses 3.1 and 5.1.

1.4 The guarantee is not transferable.

1.5 The guarantee granted by Batavus

on the grounds of these conditions

does not affect the right to claim da-

mages from the seller on the grounds

of the ordinary, statutory provisions of

the Netherlands Civil Code.

CLAUSE 2 GUARANTEE PERIOD

2.1 Batavus frames and front forks

without suspension are guaranteed

against construction and/or material

defects for 10 years.

2.2. The same guarantee applies to

suspension front forks, shock absorbers,

and all other components, with the

exception of the components referred

to in subclause 2.4 of this Clause, for a

period of 2 years.

2.3 The paintwork of the frame and

fork is guaranteed against corrosion

from the inside for a period of 2 years.

2.4 No guarantee is given for compo-

nents which are subject to wear, such

as tyres, chain, front chainwheels, free-

wheel, rear sprocket wheels, cables and

brake blocks, unless they have construc-

tion and/or material defects.

2.5 Other paintwork and chrome

components are guaranteed against

corrosion, provided they are well main-

tained, for a period of 2 years.

CLAUSE 3 EXCEPTIONS TO THE

GUARANTEE

3.1. The guarantee lapses in the follo-

wing cases, at the discretion of Batavus:

a. In the event of incorrect and/or ca-

reless use of the bicycle which is not in

accordance with its purpose;

b. The bicycle has not been maintained

in accordance with the service booklet;

c. Technical repairs have not been car-

ried out competently;

d. Components which have been

mounted afterwards do not correspond

with the technical speciﬁ cations of the

bicycle in question or have been incor-

rectly mounted;

e. If the Certiﬁ cate of Ownership sho-

wing that the bicycle has been compe-

tently completed and checked prior to

delivery to the client is not available or

has not been signed by a recognised

Batavus dealer.

3.2. Furthermore Batavus B.V. explicitly

excludes liability for damage to (com-

ponents of) the bicycle resulting from:

a. Faulty adjustment/tension in the

handlebars, steering pin, saddle, saddle

pin, derailleur set, brakes, quick release

levers of the wheels and saddle;

b. Not replacing components such as

brake/derailleur cables, brake blocks,

tyres, chain and sprocket and chainw-

heels in time;

c. Climatological inﬂ uences such as

normal weathering of the paintwork or

rusting of chrome components.

CLAUSE 4 GUARANTEE ON

COMPONENTS

4.1. During the guarantee period, all

components ascertained by Batavus

B.V. to have construction and/or materi-

al defects, will be repaired or reimbur-

sed, at the option of Batavus B.V.

Any costs of disassembly and reassem-

bly will be at the expense of the owner.

4.2. Contrary to the provisions of the

previous subclause, in the event of

construction and/or material defects in

frames and front forks, the labour costs

are also at the expense of the manu-

facturer for 3 years from the purchase

date of the bicycle.

4.3. Costs of transport of the bicy-

cle and/or components from and to

Batavus B.V. will be at the expense of

the owner, unless the component in

question is eligible for guarantee.

4.4 If a speciﬁ c component is eligible

for guarantee and the original is no

longer available, Batavus B.V. will pro-
