2. Grant of License. IQUA grants you the following rights provided that you comply with all terms and conditions of

this EULA. You may download, install, use access, display and run one copy of the Software on an iPhone

manufactured by Apple Computers, Inc.

3. iTunes/iPhone Terms. In downloading and using the Software, you agree to comply with all terms and conditions

applicable to iTunes and iPhone imposed by Apple Computers, Inc. or any other agreements associated with your use

of such devices.

4. Reservation of Rights and Ownership. IQUA reserves all rights not expressly granted to you in this EULA.

The Software is protected by copyright and other intellectual property laws and treaties. IQUA or its suppliers own

the title, copyright and other intellectual property rights in the Software. The Software is licensed, not sold.

5. Device Limitation. The Software is designed to be compatible with the IQUA BEAT headset and such other devices

as IQUA may later designate (“Device”). It is not designed to be compatible with any other headsets or devices.

You agree to use this Software solely with the Device and not with any other devices.

6. Limitation on End User Rights. You may not reverse engineer, decompile, disassemble, or otherwise attempt to

discover the source code or algorithms of the Software (except and only to the extent such activity is expressly

permitted by applicable law not withstanding this limitation), or modify, or disable any features of the Software, or

create derivative works based on the Software. You may not sell, rent, lease, lend, or provide sublicenses to the

Software.

7. Consent to Use of Data. You agree that IQUA and its affiliates may collect and use technical and other user entered

information collected. This information may include your name, email address, address, telephone number(s), areas

of interest, financial information, User ID, User Password and other self-identifying information. IQUA will not collect

any information about your workouts or from the heartbeat monitor. IQUA will use the information collected solely to

improve its products or to provide customized services and technologies to you. IQUA will not disclose this

information in a form that personally identifies you. For further information on the use of such data, please

review IQUA’s Privacy Statement, a copy of which may be found at www.iqua.com/privacy.
