6.2 LUMIGON’S TOTAL LIABILITY FOR ANY DAMAGES UNDER
THIS AGREEMENT SHALL NEVER EXCEED THE PURCHASE
PRICE YOU PAID FOR THE LUMIGON PRODUCT IN QUESTION.
6.3 Any software is not fault tolerant, whether provided
by Lumigon or a third party. The Software is designed for
systems that do not require fail-safe performance. You are not
allowed to use the Software in any phone or system in which a
malfunction of the Software could result in a foreseeable risk
of loss, injury or death to any person.
7.Indemnication
7.1 You agree to hold harmless, indemnify and defend
Lumigon, its employees, suppliers and afliates from and
against any losses, damages, nes and expenses (including
attorneys’ fees and costs) arising out of or relating to any
claims that you have (i) viewed, downloaded, encoded,
compressed, copied or transmitted any materials (other
than materials provided by Lumigon) in connection with the
Software in violation of another party’s rights or in violation of
any law, or (ii) violated any terms of this EULA.
7.2 If you are importing the Software, you shall indemnify and
hold Lumigon harmless from and against any import and
export duties or other claims arising from such importation.
8. Termination
This EULA shall be effective until terminated. Your rights under
this license agreement shall terminate automatically without
notice from Lumigon if you fail to comply with any of the
terms and conditions of this EULA.

This means that you must inform the person with whom you
